The results of a business’s non-compliance with mandatory industrial regulations in today’s climate of safety consciousness and litigation may leave any business open to huge legal charges and huge legal penalties.  

Additionally, it is a little known fact that many business insurance contracts, such as Public Liability Insurance etc, have an over-riding clause in the fine print that says that the Insurance Company is bound by their contract with the business ONLY as long as it complies with the relevant laws and safety regulations. Apparently, as soon as that business takes one step in the wrong direction, the Insurance Company may legally be able to wipe them, and in many cases they may not have to pay up to help them pay their fines and/or negligence law suits.

CHAPTER 64

  $27,500.00

  • An employer must ensure that any risk or injury from electricity at a place of work is eliminated or controlled.
  • An employer must ensure that all electrical installations are safe to use and are regularly inspected, tested and maintained.

CHAPTER 65

$3,300.00.

Records can be used as evidence that regular inspections have or have not been carried out.

  • A record must be made and kept of all electrical inspections and tests --- Name of the person who made the inspection --- Date of inspection --- Results of inspection --- Date of the next inspection.

 


 

 

CHAPTER 8

  Up to $550.00  For failing to provide a safe place of work.

  • Details the duties of the employers to provide a safe work place. --- Identifies all hazards and eliminates or control the risk a hazard can cause, damage, injury or illness. --- Items of Electrical Equipment at a place of work are a hazard and controls must be in place to protect against the risk of Electrocution.

CHAPTER 9

  up to $55,000.00 

For failure to provide a safe place of work can lead to fines  for managers, directors or self-employed person.

  • Details the duty of self employed person to ensure that in the course of their work people are not exposed to risk or injury.

  • Items of Electrical Equipment belonging to a self-employed person are a hazard and controls must be in place to protect against the risk of Electrocution.

 

CHAPTER 20

An employee can be fined $3,300.00

  • Employees have a duty of responsibility with the employer to ensure compliance with safety.

  • Suspected unsafe electrical items should be reported to management as per company policy and procedures.
